I really think the judiciary is in dire need of transformation. Or are the constitutional court judges more skilled then their collegues in the lower courts. Cause this matter were initially heard by the provincial division, on appeal the decision of the provincial division were upheld by the SCA. Now, it is safe to assume that the appraoch the con court adopted were absent in both previous courts. How is that for a blunder by both courts, or is it because they are not the con court. Better even, not of all of us do have the cash to take a matter to the highest court. Also, how many people did it happen to that did not have the cash to persue the matter further and were essentially wrongfully jailed. I has always been stupid enough to believe that State legal assistance is a myth and a waste of money or is it form of job creation.
